Employee Classification Analysis
Determining whether an employee falls into the category of exempt or non-exempt has always been a daunting task. Today it is more important than ever. With wage and hour class action lawsuits on the rise, it is imperative that companies not only pay their employees appropriately, but that they correctly classify them at the outset.

The consequences of misclassification are considerable. Some of the largest multimillion dollar awards of back pay can be attributed directly to misclassifying a non-exempt employee as exempt. The dangers are particularly apparent in California where state wage and hour laws are much more stringent when it comes to qualifying for exempt status.

In an effort to make sure that employees are fairly compensated for all time worked, Puente assists companies with reviewing their current timekeeping mechanisms – including making sure all work time is captured, that issues such as tardiness are addressed, that rounding practices are fair, and that the timekeeping system is accessible and accurate. Puente’s process for performing this work may include use of employee questionnaires, employee interviews, review of timekeeping records, review of policies and practices regarding rest and meal periods, and, if necessary, accurate calculation of wages owed at the appropriate rate.
